Old values disappear.What happens when the sun sets on you, dear Reader?When the clever things you did in your twenties, and the book learning you picked up in school, and even the scars on your back from your thirties, lose their relevance to the modern corporation?What will you do then?Because I can tell you, youâre not going to want to take a 95% haircut the way Newsweek and the newspapers did.All skills become commoditized over time. That means what was hard to do yesterday, becomes easy today, and worthless tomorrow.J.P. Morgan - the man, not the bank - became Americaâs most prominent financier by doing what we would today call asset-backed lending. If youâd told him that some day tens of thousands of kids right out of school would be doing the type of lending he did, he wouldâve scoffed at you. Wouldâve told you about the difficulty of assessing a company and its prospects, the importance of knowing the ins and outs of the resale market, the sharp eye and decisive gut needed to measure a manâs creditworthiness over a handshake.He felt this skill was specialized and immortal.But it wasnât true. A top competitor approaches you about a job opportunity and the next morning, over breakfast, youâre offered a chance to double your money and earn a fast-track promotion to the executive ranks. Next step, âJust send us your resume.âCan you legally and ethically jump to the other side? What should you - and shouldnât you - put on your resume and cover letter? How do you make this type of move without burning bridges?Your No. 1 issue is âCNCâIf youâre thinking about changing sides, your No. 1 issue is a non-compete clause or covenant-not-to-compete (CNC).If you have not signed a CNC, then youâre probably free and clear.Otherwise, to avoid a potential lawsuit against you and your new employer, you must get advice from a lawyer who specializes in employment law. Companies can and do enforce these agreements ( except in California, where theyâre generally illegal).Sometimes the CNC or non-compete clause is a separate document, and sometimes itâs buried in a job application. You might have signed one and forgotten all about it! (Important point: These agreements usually apply to your companyâs clients as well as its competitors.)Non-compete agreements are especially common with technology jobs because competition among companies is fierce and potential employees are usually willing to sign anything in a weak job market. So before a competitor considers hiring you, theyâll demand your full disclosure.What to put - and leave off - of your resume and cover letterBe very discreet. Show utmost respect for your current (or former) employer in the resume and during the interview. Never disclose any insider tidbits because any negative information reflects badly on your own character and loyalty. Rehearse your story in great detail, and donât let the interviewer lure you into this trap . Tweaking your resume for a competitor is easy. Just remove any items - direct or indirect - that might involve the competitor. If youâre in sales, for example, donât highlight any competitive wins youâve made against this particular employer. Never use personal pronouns (âwe, our, or their,â for example). This rule applies to all resume writing, and itâs especially important when youâre sending it to a competitor. If you are making the first move, use the cover letter to reveal that you are (or were) working for a direct competitor. Option: Replace your companyâs actual name with âCOMPANY CONFIDENTIALâ and just note itâs in the same marketplace. If youâre sure that you have not signed a non-compete agreement with your current employer, definitely mention that in a postscript (P.S.) at the end of your e-mail or cover letter. Scenario Four An indie label is interested in putting out your album. They cant afford to pay you a large advance because their budget is tight and they need the money for pressing and promotion. Youve already paid for recording. Good deal or bad deal? Good Deal - The idea of a big advance might be appealing, but in the long run, its not as valuable as someone spending time and money working hard to promote your music. Recouping your recording cost would be great, but the cold, hard fact of the matter is that you may not do that right out of the gate. An indie label that really believes in your music and is willing to work hard for you can do a lot to take your career to the next level, even if they cant put much cash on the table up front. Of course, in exchange for your flexibility on the advance thing, the deal you sign with the label should be nice and easy, too. Theres no need to sign a five album deal with a small label. The future is too uncertain for all parties involved, so take it one thing at a time.
